BEATRICE – A jury trial has been set for December, for a former Beatrice State Developmental Center employee charged with first-degree sexual assault of an incompetent person, abuse of a vulnerable adult and tampering with evidence.

31-year-old Allen Evans is scheduled to face trial, beginning December 11th, in Gage County District Court.  A pretrial hearing is scheduled for October 25th.

Prosecutors anticipate filing amended charges in the case, in which Evans could request a separate preliminary hearing.  Evans has waived his right to a speedy trial.

His arrest was on April 26th, of 2022…following a Nebraska State Patrol investigation of a sexual assault that allegedly occurred at BSDC.   Evans is suspected of assaulting a resident of the center in a restroom and shower.  A sexual assault nurse examiner told an investigator the injuries suffered by the resident were among the worst she had ever observed.  The evaluation was conducted at a Lincoln hospital.  

Nebraska State Patrol investigators recovered several items of evidence from a dumpster outside a building at BSDC…and conducted DNA testing on it. 

Evans has been held in the Gage County Jail since his arrest.   If convicted of the current charges against him, Evans faces the possibility of up to 55 years in prison.
