BEATRICE – A Gage County District Judge has sentenced a 31-year-old Beatrice man to prison after revoking his post-release supervision. In February of 2022, Devon Kagy was given a two-year state prison term and a year of post-release supervision for a felony violation of a protection order, with a prior conviction.


District Judge Rick Schreiner sentenced Kagy to an additional one year in prison with 129 days credit for time in custody. "It just doesn't look like you want to be on post-release supervision. There was really no reason to have a trial on your motion to revoke post-release supervision...you just completely refuse to take responsibility for your actions, and blame others. So, it would be useless for me to keep you on post-release supervision."


Chief Deputy Gage County Attorney Amanda Spracklen-Hogan said Kagy committed law violations while on post-release supervision. Gage County Public Defender Lee Timan said there was a hold on Kagy for a case pending in Jefferson County, where he did not show for sentencing in June on a conviction of possession of a deadly weapon by a prohibited person. Kagy had been arrested on a warrant.


In a separate case conducted by video hearing, 50-year-old Terry Franzen of Beatrice had his post-release supervision term of 18 months, revoked….and was given an 18-month prison term.


Franzen was sentenced in December of 2021 to a three-year-prison term for attempted burglary and 18 months of post-release supervision. The new sentence is consecutive to the prison term he is serving. He’ll be eligible for release in about nine months.
