A Nebraska developer is in hot water with the Environmental Protection Agency for alleged violations of the Clean Water Act.

LINCOLN, Neb. -- A Nebraska developer is in hot water with the Environmental Protection Agency for alleged violations of the Clean Water Act.

The EPA says that it has ordered Evergreen Development and its owner, Mark Schmidt, to restore a stream and wetlands and pay a six-figure fine.

The federal agency says its investigators found that Evergreen illegally channelized and filled in a tributary of the Little Nemaha River on the 16-acre Evergreen Place project in the town of Bennet.

The EPA says Evergreen also lets its stormwater permit lapse during construction.

There's been no word on a response from Schmidt or the company.
